Terms of Use

1. About E Naam

E Naam (meaning "reward" in Urdu/Hindi) is an Android application designed for conducting quizzes and skill-based competitions. Our quizzes cover a range of subjects, including but not limited to Mathematics, English, General Knowledge, and General Science. Questions are generally up to the 10th-grade level, though this may vary. Each quiz consists of 10 questions, with each question carrying 1 mark. Currently, there is no negative marking, but this policy may be subject to change in the future.

2. Nature of Competition

E Naam hosts **skill-based quizzes** and **competitions** where success is predominantly determined by a participant's knowledge, analytical abilities, and speed, rather than by chance.

3. Quiz Mechanics and Scoring

• Question Timing: Each question has a specific time limit for solving, determined by its perceived complexity.
• Question Sequence: The sequence of questions presented to different users is randomized.
• Ranking: Ranks are determined by the number of questions correctly answered. The user who answers the maximum number of questions correctly achieves the 1st rank, and so on.
• Tie-Breaking: In case of a tie in the number of correct answers, the sum of the time taken for only the correctly answered questions will be used as a tie-breaker (lesser time means a higher rank).

Prize Distribution in Case of Tie:

Prizes are awarded to a maximum of 5 participants. If a tie persists even after considering time taken, the prize money will be distributed as follows:

• Ties within the top 5 ranks:

  If the number of tied users for a specific rank (e.g., 2nd place) plus the number of users in all higher ranks is 5 or fewer, the tied users will equally share the combined prize money for the ranks they would have occupied.

  For example:

  • If there is 1 winner for 1st place, and 4 users tie for 2nd place, those 4 users will equally share the combined prize money for 2nd, 3rd, 4th, and 5th place.
  • If there is 1 winner for 1st place, 1 for 2nd, and 3 users tie for 3rd, those 3 users will equally share the combined prize money for 3rd, 4th, and 5th place.
• Ties that exceed the top 5 ranks:

  If the number of tied users for a specific rank, when added to the number of users in all higher ranks, totals more than 5, the participants in the higher, untied ranks will receive their prizes as normal.

  The remaining prize money (for the current rank and all subsequent ranks up to the 5th place) will be combined and divided equally among all participants who are tied for the current rank.

  For example:

  • If there is 1 winner for 1st place and 5 users tie for 2nd place, the 1st-place winner will receive their prize as normal. The prize money for 2nd, 3rd, 4th, and 5th place will be combined and distributed equally among the 5 users tied for 2nd place.
  • If 6 users tie for 1st place, the total prize money for all 5 ranks will be combined and divided equally among all 6 users.
• Invalid Answers: Answers received by our server after a predefined time (total quiz time + 1 minute buffer, subject to change) will be considered invalid.

4. Participation and Access

• Access Requirement: Users can access a quiz by watching a variable number of advertisements.
• User Limit: Each quiz may have a maximum user limit for registration. This limit, if applied, is determined by E Naam and will be displayed on the app and website.

5. Technical Issues During Quiz

In the event of widespread technical problems affecting a significant number of users during a quiz, and if we determine that these issues are not isolated individual problems, we may decide to re-conduct the quiz with different questions on an alternative date. In such cases, the prize distribution will be carried over to the rescheduled quiz event.

6. Winner Details and Prize Distribution

• Winners: Prizes will be awarded to the top 5 winners (Rank 1 to Rank 5).
• Prize Distribution: Prizes are fixed amounts for the top 5 positions and are not based on the number of participants. The fixed prize amounts may change and will always be displayed on the app and website. We are not legally bound to give the prizes always, as it depends on our discretion.
• Prize Disbursement: Winners will be notified on the app about their victory. To claim their prize, they must send their bank account number to the designated WhatsApp or email address that will be provided. In cases where we doubt a winner's identity, we may ask for other legal details to verify their information.
• TDS Deduction: Tax Deducted at Source (TDS) will be applicable as per Indian tax laws, and the remaining prize money, if disbursed, will be transferred to the winner.
• Public Disclosure of Winner Details: After quiz results are declared, the following details of winners will be made public: photos, name, address, score, rank, time taken, and prize money received.

7. Question Accuracy and Grievance Policy

We strive for accuracy in our questions and options. However, human errors are possible. If a user identifies any mistake in a question or believes that our designated correct answer is incorrect, they must contact us within 6 hours of the quiz results being declared. If we determine the claim to be genuine, we will re-evaluate the results and declare them again. After the 6-hour window, no further claims or corrections regarding questions will be entertained, and any perceived mistakes shall be considered as human errors.

8. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using any automated system, including bots, scripts, or similar tools, to access or interact with the app.
• Creating or operating multiple accounts to gain an unfair advantage or bypass restrictions.
• Attempting to hack, interfere with, or disrupt the integrity or security of the app or its servers.
• Sharing quiz answers or engaging in any form of collusion with other users.
• Using offensive, abusive, or inappropriate language towards other users or E Naam staff.
• Engaging in any activity that is fraudulent, illegal, or in violation of these Terms of Use.
• Attempting to reverse engineer, decompile, or disassemble any part of the app.
• Using the app for any unauthorized commercial purposes.

Any violation of these rules may result in immediate account suspension or termination, forfeiture of any winnings, and potential legal action.

9. Disqualification and Withholding of Prizes

E Naam reserves the right to disqualify users and withhold prizes under the following circumstances:

• Age Verification: The app is intended for users 13 years and older. If a user is found to be under 13 years of age on the day of the quiz, their prize will be withheld, and their rank will be reshuffled among other eligible participants. Users under 18 may use a parent's bank account to receive the prize amount in case they do not have one, provided they can prove their relationship to the account holder.
• Identity Verification: If, upon winning, the name, address, or gender provided by the user during registration differs from their legal documents and bank account details, their prize amount may be withheld if we doubt their true identity.

Privacy Policy

1. Information We Collect

To use our services, we only collect the following minimal information from you:

• Name: To identify you as a user.
• Address: For prize disbursement and legal purposes.
• Gender: For statistical and demographic analysis.
• Photo: For your profile picture. This does not require any storage permission from your device.

We do not collect any personally identifiable information beyond what is stated above. We specifically do not collect your phone number.

2. How We Use Your Information

The information we collect is used to:

• Identify you as a user within the app.
• Process and disburse fixed prize amounts to contest winners.
• Verify your identity in case of a win.
• Display your name, address, photo, score, and rank if you are a contest winner.
• Send you important app-related notifications.

3. Data Security and Retention

We are committed to protecting your personal information. We use reasonable administrative, technical, and physical safeguards to protect the information we collect. We retain your information only for as long as necessary to provide our services and for legitimate business purposes as outlined in this policy.

4. Third-Party Advertisements

Our app is supported by advertising. We work with third-party ad networks to display advertisements within the app. These ad networks may collect and use certain information about your device, such as your device ID, to serve personalized ads. We do not share the personal information you provide to us (name, address, gender, photo) with these third-party ad networks.

We use the Appodeal advertising SDK to manage and display advertisements. Appodeal may mediate ads from multiple third-party ad networks, including Google AdMob.

Advertising partners may automatically collect information such as Advertising ID, IP address, device type, operating system, and approximate location derived from IP address for the purpose of ad delivery, analytics, fraud prevention, and personalized or non-personalized advertising.

5. Your Rights and Choices

Consent Management Platform (CMP)

E Naam uses a Consent Management Platform provided via the Appodeal SDK to comply with applicable privacy regulations, including GDPR (European Union) and CCPA/CPRA (California).

Where required by law, users are shown a consent dialog allowing them to choose whether to receive personalized or non-personalized advertisements. User consent choices are stored securely and respected by advertising partners.

6. Permissions We DO NOT Use

E Naam does not request or use intrusive permissions such as access to your location or contacts on your device. The only permission we request is **Notification access**, which is solely used to send you important quiz updates, announcements, and reminders.

7. Changes to This Privacy Policy

E Naam may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any significant changes by posting the new Privacy Policy on this page, and/or through in-app notifications or a prominent notice on our website. You are advised to review this Privacy Policy periodically for any changes. Your continued use of the app after the posting of changes constitutes your acceptance of such changes.
